Car Rental Terms & Conditions

1. Definitions

• “Company” refers to Sax Car Rental

• “Renter” refers to the individual or entity renting the vehicle.

• “Vehicle” refers to the car or other vehicle provided under the rental agreement.

• “Rental Period” means the time from vehicle pickup to vehicle return as agreed.

2. Eligibility Requirements

• The Renter must be at least 21 years old. A $5/day young-driver fee applies.

• An acceptable government-issued ID and valid payment method are required at pickup.

• Additional drivers must be approved and listed in the rental agreement.

3. Booking and Reservations

• Reservations are subject to vehicle availability.

• The Company reserves the right to substitute a comparable vehicle if the reserved vehicle is unavailable.

• Online bookings do not guarantee vehicle availability until confirmed by the Company.

4. Rental Period and Vehicle Use

• The Vehicle may only be used for lawful purposes.

• The Vehicle must not be used for:

  • Racing, towing, or off-road driving

  • Commercial use (e.g., ride-hailing or delivery), unless explicitly approved

  • Transporting hazardous materials

• Only authorized drivers may operate the Vehicle.

• The Vehicle may be driven anywhere on Sint Maarten/St. Martin, including the French side — there are no borders or driving restrictions on the island.

5. Fees, Charges, and Payment

• Rental rates are charged per day or per hour, as stated at booking.

• The Renter is responsible for:

  • Fuel charges (unless fuel is prepaid)

  • Tolls, parking tickets, traffic violations, and administrative fees

  • Late return fees

• A $250 security deposit is held on the Renter’s payment method and released after vehicle return, subject to inspection. The deposit must be paid by card — cash deposits are no longer accepted.

6. Insurance and Liability

• Basic insurance coverage is not included in the rental price by default; zero-deductible coverage options are available separately. If paying with a debit card, Liability Insurance (or Supplementary Liability Insurance) is mandatory.

• The Renter remains responsible for:

  • Damage due to negligence or misuse

  • Loss of the Vehicle or keys

  • Any uninsured or excess amounts

• The Renter’s personal insurance or credit card coverage may apply, subject to their terms.

7. Vehicle Condition and Maintenance

• The Vehicle is provided in clean and roadworthy condition.

• The Renter must inspect the Vehicle at pickup and report any existing damage.

• The Renter agrees to return the Vehicle in substantially the same condition, excluding normal wear and tear.

8. Accidents, Damage, and Theft

• Any accident, damage, or theft must be reported to the Company and local authorities immediately.

• The Renter must not admit fault or settle claims without the Company’s consent.

• Failure to report incidents may result in full liability.

9. Cancellation and No-Show Policy

• Cancellations made more than 48 hours before pickup are free of charge.

• Cancellations or modifications made within 48 hours of pickup are subject to a fee equal to 50% of the total rental amount. No-shows may incur the same fee or forfeiture of prepaid amounts.

10. Termination

• The Company may terminate the rental immediately if the Renter breaches these Terms.

• Upon termination, the Vehicle must be returned immediately, and all outstanding charges become due.

11. Limitation of Liability

• To the extent permitted by law, the Company is not liable for indirect or consequential losses, including loss of personal property left in the Vehicle.

12. Privacy and Data Protection

• Personal data is collected and processed in accordance with the Company’s Privacy Policy.

• Data may be shared with insurers, authorities, or service providers as required.

13. Governing Law and Jurisdiction

• These Terms are governed by the laws of St. Maarten.

• Any disputes shall be subject to the exclusive jurisdiction of the courts of St. Maarten.

14. Changes to Terms

• The Company reserves the right to update these Terms at any time.

• Continued use of the Vehicle or website constitutes acceptance of the updated Terms.
